Terms of Use
Effective 17 September 2026
1. Who We Are and What These Terms Cover
These Terms of Use ("terms") are an agreement between you and Digital Nomad Studio ("we", "us" or "our"). They govern your use of the mobile applications we publish on the Apple App Store (each an "app" and together "our apps") and of our websites. By downloading, installing or using an app, you agree to these terms. If you do not agree, do not use the app.
Some apps have additional terms, pricing or feature limits described in the app or in its App Store listing. Where an app-specific term conflicts with these terms, the app-specific term applies to that app. Our Privacy Policy explains how we handle personal information and forms part of these terms.
2. Eligibility
You must be at least 13 years old to use our apps, or older if the law where you live requires it. If you are under 18, you must have a parent or guardian's permission to use an app and to make any purchase, and they must agree to these terms on your behalf. Our apps are not directed at children under 13.
3. Your Licence
We grant you a personal, non-exclusive, non-transferable, revocable licence to use our apps on Apple devices that you own or control, in line with these terms and the App Store rules. You may not copy, modify, distribute, sell, rent or lease any part of an app, and you may not reverse-engineer an app or attempt to extract its source code, except where the law allows this despite these terms.
4. Accounts
Some apps let you create an account or sign in. Keep your login details secure, give us accurate information, and tell us promptly if you suspect unauthorised use. You are responsible for activity that happens under your account. Where an app does not offer a way to delete your account, you can ask us to delete it by contacting us.
5. Purchases and Subscriptions
Some apps are free, some offer a free tier with limits, and some offer one-time purchases or auto-renewing subscriptions that unlock features or higher limits. All purchases are made through your Apple account and are subject to Apple's payment terms.
- Subscriptions renew automatically at the end of each billing period unless you cancel at least 24 hours before it ends. You can manage or cancel a subscription at any time in your Apple account settings. Cancelling stops future renewals but does not refund the current period.
- If a free trial is offered, your subscription starts and is charged when the trial ends unless you cancel before then.
- Prices may change. If the price of your subscription changes, you will be notified as required by the App Store, and continued renewal counts as acceptance of the new price.
- One-time purchases are tied to your Apple account and can be restored on your other Apple devices using the app's restore purchases option.
- Refunds are handled by Apple under the App Store terms. Where the law gives you refund rights, including under the Australian Consumer Law, those rights are not affected.
Some apps offer licences for organisations such as clubs, schools or businesses under a separate agreement. Where that agreement covers your use, it applies alongside these terms.
6. Acceptable Use
Use our apps only where you may lawfully do so. You must not use an app to harass, deceive or harm others, to violate anyone's privacy or intellectual property rights, to record or broadcast people without any consent the law requires, to interfere with networks, devices or accounts you do not have permission to use, or to attempt to bypass purchase, subscription or usage limits. You are responsible for what you record, say, upload or share through an app.
7. Your Content
Content you create or add in an app, such as photos, video, audio, recordings, notes, documents and branding, stays yours. We claim no ownership of it. You give us only the limited licence needed to run the features you use, for example processing a document you upload so the app can produce a report for you. Many of our apps process content entirely on your device and never send it to us. The details for each app are in our Privacy Policy.
You must have the rights and any necessary consents for content you add, including permission to film or record other people where the law requires it.
8. Automated Results and No Professional Advice
Our apps produce results automatically, including transcriptions, translations, tags, analysis, summaries, scores and generated reports. These are usually good, but they can be wrong, incomplete or out of date. Our apps provide information and tools, not professional advice. They are not a substitute for medical, psychological, legal, financial, building, safety or other professional advice, and they must not be relied on where an error could cause harm, including in medical, legal, financial, emergency or safety-critical situations. Always confirm anything important with a qualified professional. If you are in crisis or in danger, contact your local emergency services.
9. Our Property
Our apps, their names, logos, designs, code and content, and our websites are our property or that of our licensors and are protected by intellectual property law. These terms do not give you any right to use our branding. If you send us feedback or suggestions, we may use them to improve our products without any obligation to you.
10. Third-Party Services and Links
Our apps run on Apple platforms and may use third-party services, such as Apple's speech, translation and payment frameworks, mapping services or cloud infrastructure. Those services are governed by their own terms, and we are not responsible for third-party services or for external websites we link to. You must comply with any third-party terms that apply to your use, including your mobile carrier's data terms.
11. Apple App Store Terms
Because you obtain our apps from the Apple App Store, the following also applies:
- These terms are between you and us only, not with Apple. We, not Apple, are solely responsible for our apps and their content.
- Apple has no obligation to provide maintenance or support for our apps.
- If an app fails to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price you paid for that app. To the maximum extent permitted by law, Apple has no other warranty obligation, and any other claims, losses, liabilities, damages, costs or expenses attributable to a failure to conform to a warranty are our responsibility.
- We, not Apple, are responsible for addressing any claims by you or a third party relating to an app or your use of it, including product liability claims, claims that an app fails to conform to a legal or regulatory requirement, claims under consumer protection or similar laws, and claims that an app infringes a third party's intellectual property rights.
- You represent that you are not located in a country that is subject to a United States government embargo or that has been designated by the United States government as a "terrorist supporting" country, and that you are not listed on any United States government list of prohibited or restricted parties.
- Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.
12. Our Apps Are Provided "As Is"
To the extent permitted by law, our apps and websites are provided "as is" and "as available", without warranties of any kind, express or implied, including fitness for a particular purpose, accuracy of results, and uninterrupted or error-free operation. Connectivity and performance depend on your devices, network and environment. We may change, suspend or discontinue features, or an entire app, at any time.
13. Limitation of Liability and Australian Consumer Law
Nothing in these terms excludes, restricts or modifies any consumer guarantee, right or remedy you have under the Australian Consumer Law or any other law that cannot lawfully be excluded. Where our liability for breach of a consumer guarantee can be limited, it is limited, at our option, to supplying the relevant service again or paying the cost of having it supplied again, or, for goods, to repairing or replacing them or paying the cost of doing so.
Otherwise, to the fullest extent permitted by law, we are not liable for indirect, incidental, special or consequential losses, or for loss of data, profits, revenue or goodwill, arising from your use of or inability to use our apps, and our total liability for all claims relating to an app is limited to the amount you paid us for that app in the 12 months before the claim.
14. Ending or Changing These Terms
You can stop using an app at any time by deleting it. Deleting an app does not cancel an active subscription, which you must cancel in your Apple account settings. We may suspend or end your access to an app if you breach these terms.
We may update these terms from time to time. When we do, we will change the effective date above and, for material changes, flag them in the app or on this site. Continued use after a change means you accept the updated terms.
15. Governing Law
These terms are governed by the laws of Australia, and disputes are subject to the non-exclusive jurisdiction of the Australian courts. If the consumer protection law where you live gives you rights to bring claims locally, those rights are unaffected.
